{"id":81,"date":"2016-01-28T14:50:24","date_gmt":"2016-01-28T21:50:24","guid":{"rendered":"http:\/\/www.century21yk.ca\/blog\/?p=81"},"modified":"2022-03-05T09:55:27","modified_gmt":"2022-03-05T16:55:27","slug":"yellowknife-homebuyer-101-are-you-a-realtors-client-or-customer","status":"publish","type":"post","link":"https:\/\/www.century21yk.ca\/blog\/2016\/01\/yellowknife-homebuyer-101-are-you-a-realtors-client-or-customer\/","title":{"rendered":"The Buyer Representation Advantage"},"content":{"rendered":"<div class=\"blog-post-body\">\n<p>Even if they haven&#8217;t experienced it directly, most Yellowknife homebuyers are familiar with the concept of Buyer Representation.\u00a0 It&#8217;s what they see when they watch real estate Reality TV, and it&#8217;s what they usually hear about from family and friends who purchase property in other cities.\u00a0 Buyer Representation has been around since the 1990s in the provinces and is considered to be a very valuable service, but until we began offering it in 2012 it\u00a0was very rarely practiced in the Northwest Territories.<\/p>\n<p>Yes, local Realtors worked <em>with<\/em> buyers before 2012, but they generally didn\u2019t work <em>for<\/em> buyers.\u00a0 The difference is subtle and yet incredibly important.\u00a0 It can mean the difference between simply being sold a home, or getting the best possible deal on a home.<\/p>\n<p>To understand the distinction between working <em>with<\/em> or <em>for<\/em> a buyer, it helps to think in terms of other professions.\u00a0 Take a car dealership as an example.\u00a0 When a man walks into a car dealership he usually seeks the help of a saleperson.\u00a0 The salesperson will work <em>with<\/em> the prospective buyer, but won&#8217;t work <em>for<\/em> him or look out for his best interests.\u00a0 The buyer is merely a customer.\u00a0 The salesperson is looking out for the best interests of the owner of the car dealership.\u00a0 The buyer is well aware of the fact he is unrepresented in the purchase transaction.\u00a0 It&#8217;s a case of<em> caveat emptor<\/em> \u2013 \u201clet the buyer beware.\u201d<\/p>\n<p>Compare this with a woman who walks into a law office seeking legal services.\u00a0 She doesn&#8217;t want a lawyer to merely think of her as a customer, she wants a client relationship with a lawyer who is acting as her representative and &#8220;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Fiduciary\" target=\"_blank\" rel=\"noopener\">fiduciary<\/a><a href=\"http:\/\/www.merriam-webster.com\/dictionary\/fiduciary\">&#8220;<\/a> &#8211;\u00a0 a trusted professional who owes her duties of obedience, loyalty, disclosure, confidentiality, accountability and reasonable care and due diligence.<\/p>\n<p>When it comes to the services one would expect to receive, there is a big difference between being a client and being merely a customer.\u00a0 The question is, which of these two scenarios applies to the relationship between a homebuyer and a Realtor?\u00a0 The answer is that they both do, depending on who the buyer is working with.\u00a0 This can be confusing and can lead to costly mistakes if a buyer assumes he is in a client relationship when in fact he is being treated as a customer.<\/p>\n<p>In the real estate world the customer relationship (e.g. car salesperson) is referred to as\u00a0 \u201cNo Agency.\u201d\u00a0 The buyer is treated as a customer rather than as a client.\u00a0 The Realtor must treat the buyer honestly and fairly, but does not owe the buyer loyalty, confidentiality, due diligence, or any of the other fiduciary obligations.\u00a0 And in fact the Realtor cannot negotiate on the buyer&#8217;s behalf because the Realtor is legally bound to look out for the best interests of the seller.\u00a0 Prior to 2012, Yellowknife Realtors generally worked under &#8220;No Agency&#8221; relationships with buyers and owed their loyalty to sellers on MLS transactions.<\/p>\n<p>By contrast, Buyer Representation, or &#8220;Designated Agency&#8221;as it&#8217;s also known, is a client relationship.
